In their response to our article (Keestra and Cowley, 2009), Hacker and Bennett charge us with failing to understand the project of their book Philosophical Foundations of Neuroscience (PFN; Bennett and Hacker, 2003) and do this by discussing foundationalism, linguistic conservatism and the passivity of perception. In this rebuttal we explore disagreements that explain the alleged errors. First, we reiterate our substantial disagreement with Bennett and Hacker (B&H) regarding their assumption that, even regarding much debated concepts like (...) ‘consciousness’, we can assume conceptual consensus within a community of competent speakers. Instead, we emphasize variability and divergence between individuals and groups in such contexts. Second, we plead for modesty in conceptual analysis, including the use of conceptual ambiguities as heuristics for the investigation of explanatory mechanisms. Third, we elucidate our proposal by discussing the interdependence of perception and action, which in some cases appear to be problematic for PFN. Fourth, we discuss why our view of conceptual innovation is different from B&H’s, as we plead for linking explanatory ingredients with conceptual analysis. We end by repeating our particular agreement with their mereological principle, even though we present different reasons: psychological concepts should not be applied to mere components or operations of explanatory mechanisms, for which another vocabulary should be developed. Since Bennett, Draper, and Frith published a paper in this journal in 2000 considering the possible criminalisation of HIV transmission, an important legal development has taken place. February 2001 saw the first successful United Kingdom prosecution for the sexual transmission of disease for over a century, when Stephen Kelly was convicted in Glasgow of recklessly injuring his former girlfriend by infecting her with HIV. Whether English criminal law can apply criminal penalties in such a case, however, still remains (...) uncertain.This paper, in addition to providing some background to the Kelly case, briefly explores the current possibilities for prosecution under English law. It then proceeds to outline and comment on the issues relevant to criminalisation, responding in part to points made by Bennett, Draper, and Frith and also by Bird and Leigh Brown in a recent article in the British Medical Journal. The theories I have in mind derive from earlier work by H. P. Grice, but have undergone extensive development and modification in the hands of Grice himself,, Stephen Schiffer, Jonathan Bennett and others. Recently in these pages it has been argued that a relatively straightforward version of an old argument based on evolutionary biology and psychology can be employed to support the view that innate ideas are a naturalistic source of metaphysical knowledge. While sympathetic to the view that the “evolutionary argument” is pregnant with philosophical implications, I show in this paper how it needs to be developed and deployed in order to avoid serious philosophical difficulties and unnecessary complications. I sketch a revised (...) version of the evolutionary argument, place it in a new context, and show that this version in this context is not vulnerable to the standard criticisms levelled against arguments of this general type. The philosophical import of this version of the argument lies not in any metaphysical conclusions it sanctions directly, but in the support it lends to the metaphilosophy of commonsense. (shrink)

This chapter examines one class of public emotions – the “political emotions,” such as patriotism and promotion of the national interest and how they are, or are not, compatible with good journalism in a global media era. To what extent is journalism ethics, as we have known it, compatible with patriotism and love of nation? Can nation-based political emotions provide appropriate primary values for a global ethics and an emerging global media ethics? With regard to the first question, the chapter (...) argues that only a moderate patriotism is compatible with the principles of journalism ethics in a democracy. This essay responds to Hirstein, Sifferd and Fagan’s book, Responsible Brains, which claims that executive function is the guiding mechanism that supports both responsible agency and the necessity for some excuses. In contrast, I suggest that executive function is not the universal acid and the neuroscience at present contributes almost nothing to the necessary psychological level of explanation and analysis. To the extent neuroscience can be useful, it is virtually entirely dependent on well-validated psychology to correlate with the neuroscientific variables (...) under investigation. The essay considers what executive function is and what the neuroscience adds to our understanding of it. Then it addresses moral and legal responsibility generally, and specific doctrines. The publication of Michel Foucault’s lectures at the Collège de France in the late 1970s has provided new insight into crucial developments in his late work, including the return to an analysis of the state and the introduction of biopolitics as a central theme. According to one dominant interpretation, these shifts did not entail a fundamental methodological break; the approach Foucault developed in his work on knowledge/power was simply applied to new objects. The present article argues that this reading — (...) which is colored by the overwhelming privilege afforded to Discipline and Punish in secondary literature — obscures an important modification in Foucault’s method and diagnostic style that occurred between the introduction of biopolitics in 1976 (in Society Must Be Defended) and the lectures of 1978 ( Security, Territory, Population) and 1979 ( Birth of Biopolitics). Foucault’s initial analysis of biopolitics was couched in surprisingly epochal and totalizing claims about the characteristic forms of power in modernity. The later lectures, by contrast, suggest what I propose to call a ‘topological’ analysis that examines the ‘patterns of correlation’ in which heterogeneous elements — techniques, material forms, institutional structures and technologies of power — are configured, as well as the redeployments through which these patterns are transformed. I also indicate how attention to the topological dimension of Foucault’s analysis might change our understanding of key themes in his late work: biopolitics, the analysis of thinking, and the concept of governmentality. War metaphors are ubiquitous in discussions of everything from political campaigns to battles with cancer to wars against crime, drugs, poverty, and even salad. Why are warfare metaphors so common, and what are the potential benefits and costs to using them to frame important social and political issues? We address these questions in a detailed case study by reviewing the empirical literature on the subject and by advancing our own theoretical account of the structure and function of war metaphors in (...) public discourse. We argue that war metaphors are omnipresent because they draw on basic and widely shared schematic knowledge that efficiently structures our ability to reason and communicate about many different types of situations, and they reliably express an urgent, negatively valenced emotional tone that captures attention and motivates action. Nevertheless, we find that the meaning of war metaphors is intimately tied to the context in which they are used, which may result in either positive or negative outcomes, depending on the situation. Thus, blanket statements about whether or not a war frame is useful are misguided or overly constraining. Here we situate our case study results in relation to popular theories of metaphoric representation and processing and offer some guidelines for using a war framing effectively. This work helps illuminate the complex, dynamic, and nuanced functions of metaphor in cognition in general, and in public discourse in particular. (shrink)

Using Currie's critique as a foil, this paper reconstructs Lakatos's thesis that historiography of science is laden with normative assumptions about scientific rationality. It is argued that this thesis comprises both a heuristic claim and a constitutive claim. The Received Critique of Lakatos fails to see that "internal history" and "rational reconstruction" receive a special meaning (by which they designate "rational preconstructions") when used in the context of the heuristic claim. Currie avoids this mistake, but attributes to Lakatos an "investigation-surrogate (...) claim" which misrepresents the heuristic claim, oversimplifying the relation Lakatos envisions between hard cores and the solutions they generate. According to a natural view of instrumental normativity, if you ought to do φ, and doing ψ is a necessary means for you to do φ, then you ought to do ψ. In “Instrumental Normativity: In Defense of the Transmission Principle,” Benjamin Kiesewetter defends this principle against certain actualist-inspired counterexamples. In this article I argue that Kiesewetter’s defense of the transmission principle fails. His arguments rely on certain principles—Joint Satisfiability and Reason Transmission—which we should not accept in the unqualified forms (...) needed to establish his conclusion. (shrink)

Disrupting Journalism Ethics sets out to disrupt and change how we think about journalism and its ethics. The book contends that long-established ways of thinking, which have come down to us from the history of journalism, need radical conceptual reform, with alternate conceptions of the role of journalism and fresh principles to evaluate practice. Through a series of disruptions, the book undermines the traditional principles of journalistic neutrality and "just the facts" reporting. It proposes an alternate philosophy of journalism as (...) engagement for democracy. The aim is a journalism ethic better suited to an age of digital and global media. As a philosophical pragmatist, Stephen J. A. Ward critiques traditional conceptions of accuracy, neutrality, detachment and patriotism, evaluating their capacity to respond to ethical dilemmas for journalists in the 21st century. Ibram X. Kendi’s bestselling book How to be an Antiracist (2019) has been enormously influential and deserves the serious attention it has received. It follows his important historical work Stamped from the Beginning: The Definitive History of Racist Ideas in America (2016), which is much more scholarly and won the National Book Award the year it came out. But these books seem to take for granted a fairly simple version of cultural relativism in ethics that is widely regarded by moral (...) philosophers as seriously defective. I want to take these doubts further and show that cultural relativism is a disastrous theoretical choice for an anti-racist like Kendi to make. In Section I I explain the kind of relativism I have in mind: agent-based, cultural, normative ethical relativism. In Section II, using the two books I have mentioned, I give textual support to my attribution of this kind of relativism to Kendi. In Section III I argue for my theoretical-disaster claim and defend it against some Kendi-inspired criticism. In Section IV I address some serious relativist doubts about ethical universalism, the opposite of relativism. Finally, in Section V I offer some brief concluding remarks. (shrink)

We report an empirical study of elementary algebra errors, conducted in three separate schools. The errors are diagnosed using mal‐rules, as proposed by Sleeman (1984, 1,985). Our analysis uncovers the following properties of algebra mal‐rules: The frequency of mal‐rules is severely skewed, there are many infrequent mal‐rules and few frequent ones; mal‐rules are very unstable, students typically use mal‐rules very irregularly; different mal‐rules have explanatory power in different schools (many of our most powerful mal‐rules are previously unreported); mal‐rule diagnosis Is (...) more successful with more skilled students; students' confidence ratings do not partition the total set of mal‐rules, every mal‐rule we find is associated with high confidence ratings by at least one student.
